Barnier’s Moratorium Suggestion Sparks Debate on France’s CSRD Compliance

French Prime Minister Michel Barnier recently suggested a “moratorium” to delay implementing the Corporate Sustainability Reporting Directive (CSRD) in France, citing the heavy burden on French companies. His remarks, shared on October 20, indicate a potential re-evaluation of this EU-wide regulation, which imposes extensive sustainability reporting requirements on companies across Europe. Despite being one of the first countries to adopt the CSRD, Barnier noted that the directive’s rigorous requirements could threaten French businesses’ competitiveness. 

The French Senate backed this perspective on October 23, pushing for a qualitative assessment of the CSRD’s impacts, with a report due by July 2025 to recommend simplifications. This assessment could provide an avenue for streamlining obligations in France, but Barnier’s comments hint at a more profound pause or modification. 

Introduced EU-wide in 2023, the CSRD mandates comprehensive sustainability disclosures from approximately 50,000 EU and 10,500 non-EU companies, phased in starting in 2024. Barnier’s call for a moratorium aligns with recent EU discussions, including Mario Draghi’s competitiveness report and the recent European Commission guidelines from Ursula von der Leyen. 

However, France could face political backlash from the EU for delaying, as Brussels has already initiated proceedings against 17 member states lagging in CSRD adoption. Additionally, companies currently preparing to meet their 2024 reporting obligations could face further confusion amid potential delays. Business leaders argue that clear guidance on compliance specifics, such as information granularity, would be more beneficial than postponements. 

Ultimately, while a moratorium could ease domestic regulatory pressures, many large French companies with operations across Europe would still need to meet CSRD requirements in other EU states, potentially diminishing the moratorium’s impact.
