The proliferation of EU-based environmental, social, and governance (ESG) regulations is set to significantly impact Australian businesses with operations, supply chains, or value chains exposed to EU markets. As the EU tightens its ESG regulatory framework, Australian companies must adapt to remain competitive and compliant.
One of the key regulations is the EU’s Corporate Sustainability Due Diligence Directive (CSDDD), which mandates human rights and environmental due diligence for companies with a turnover of at least €450 million in the EU, regardless of their domicile. This regulation is expected to influence global practices, pushing Australian entities to align with stricter ESG standards to maintain partnerships with EU businesses.
The EU’s Deforestation Regulation also presents challenges for Australian exporters, particularly those dealing in commodities like timber, cocoa, and coffee. This regulation requires exporters to demonstrate that their products are not sourced from deforested land, creating new trade barriers. Given the EU’s stringent definition of deforestation, Australian businesses must thoroughly assess their supply chains to ensure compliance.
Additionally, the EU’s Ecodesign for Sustainable Products Regulation (ESPR) will require Australian exporters to meet specific product sustainability standards. This regulation aims to improve product circularity, energy efficiency, and environmental impact, necessitating significant adjustments in manufacturing and design processes.
The introduction of carbon-border adjustment mechanisms (CBAM) further complicates the landscape. These mechanisms aim to equalize the carbon costs of goods produced outside the EU with those produced within it, potentially increasing costs for Australian exporters of carbon-intensive goods.
